Welcome to Garden Social, operated by Garden Media LLC ("we," "us," or "our"). By accessing or using Garden Social at gardennj.social (the "Platform"), you agree to be bound by these Terms of Service. Our Privacy Policy is incorporated into these Terms by reference. Please read both carefully. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age to use Garden Social. By creating an account, you represent and warrant that you meet this requirement. Accounts we determine to belong to a person under 18 will be terminated and the associated personal information deleted.

2. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You may not share your account, sell it, or transfer it to anyone else. Garden Media LLC reserves the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use Garden Social to:

  • Post content that is unlawful, threatening, abusive, defamatory, or obscene
  • Harass, bully, stalk, or intimidate other users
  • Post sexually explicit content, nudity, or pornography
  • Post any content that sexualizes a minor, or any content depicting the abuse or exploitation of a minor
  • Post threats of violence, or promote or glorify self-harm, suicide, or eating disorders
  • Publish another person's private information — including home address, phone number, or workplace — without their consent
  • Impersonate any person or entity, or misrepresent your affiliation with one
  • Post content you know to be false in order to deceive or harm others
  • Spam, advertise, or promote commercial services without authorization
  • Violate the intellectual property rights of others
  • Attempt to gain unauthorized access to any part of the Platform
  • Scrape, crawl, or harvest data from the Platform by automated means without our written permission
  • Upload malware, viruses, or other malicious code
  • Create a new account to evade a suspension, termination, or block

4. User Content

You retain ownership of content you post on Garden Social. By posting, you grant Garden Media LLC a non-exclusive, royalty-free, worldwide license to host, display, distribute, and promote your content on and in connection with the Platform. This license ends when you delete the content or your account, except that copies other users have reposted or quoted may persist.

You are solely responsible for your content and its accuracy, and you represent that you have the rights necessary to post it. We reserve the right to remove any content that violates these Terms at our discretion. Garden Social is a public platform — see our Privacy Policy for what is publicly visible.

5. Reporting Content and Safety Tools

If you encounter content or behavior that violates these Terms, report it to us at admin@gardennj.social. We review reports and aim to respond to reports of objectionable content within 24 hours. Depending on what we find, we may remove content, warn a user, or suspend or terminate an account.

You can also block any user directly from their profile. Blocking prevents that person from messaging you, commenting on your posts, or following you, and removes their content from your feeds.

6. Automated Accounts and AI

Garden Social features automated accounts — including Garden Sports, Garden Politics, Garden Events, and Garden Government — that aggregate publicly available news, sports information, event listings, and government records from third-party sources. This content is provided for informational purposes only and does not constitute an endorsement, legal advice, or an official record.

Some of this content is summarized using AI, and posts involving AI summarization are labeled as such. AI summaries can contain errors or omissions; always consult the linked original source before relying on anything. Garden Media LLC does not claim ownership of aggregated third-party content and links directly to original sources. If you believe your content has been included in error, contact us at admin@gardennj.social.

7. Third-Party Content and Links

Events. Event listings are sourced from third parties and from other users. Dates, times, venues, prices, and availability change, and events are cancelled. We do not verify event information and are not responsible for it. Confirm details with the organizer or venue before making plans.

GIFs. Our GIF search is provided by Giphy. Giphy's library is hosted and rated by Giphy, not by us, and it is not screened by our moderation tools. It may include content that is mature, suggestive, or offensive. Use of the GIF feature is at your discretion.

External links and previews. Posts may link to third-party websites and display automatically generated previews. We do not control, endorse, or take responsibility for third-party sites or their content.

8. Content Moderation

We use automated tools including OpenAI and AWS Rekognition to screen text and images for violations of these Terms. Automated moderation is applied at every point where content enters the Platform, but it is not perfect — it will sometimes miss violations and sometimes flag content incorrectly. If you believe content was incorrectly flagged or removed, you may appeal by contacting us at admin@gardennj.social.

9. Intellectual Property

The Garden Social name, logo, and Platform design are the property of Garden Media LLC. You may not use our branding without prior written permission. All other trademarks referenced on the Platform belong to their respective owners.

10. Copyright Complaints

If you believe content on Garden Social infringes your copyright, send a notice to admin@gardennj.social including: your contact information; identification of the work you claim is infringed; identification of the material on the Platform and enough detail for us to locate it; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and your signature.

We will remove or disable access to material that is the subject of a valid notice, and we will terminate the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you may send a counter-notice to the same address.

11. Disclaimer of Warranties

Garden Social is provided "as is" and "as available" without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses, or that any content on it is accurate. Your use of the Platform is at your sole risk.

We are not responsible for content posted by users or aggregated from third parties, and we do not endorse it. Any interaction you have with another user is solely between you and that user.

12. Limitation of Liability

To the fullest extent permitted by law, Garden Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Platform will not exceed one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless Garden Media LLC and its officers, members, and agents from any claim, demand, loss, or expense — including reasonable attorneys' fees — arising out of your content, your use of the Platform, or your violation of these Terms or of any law or third-party right.

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately, and you may not create a new account to circumvent the termination. Sections 4, 11, 12, 13, 15, and 17 survive termination.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Monmouth County, New Jersey, and you consent to the jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. The date at the top reflects the most recent revision. We will notify users of significant changes via email or a notice on the Platform. Continued use of Garden Social after changes constitutes acceptance of the updated Terms.

17. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and Garden Media LLC regarding the Platform. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
